Really user-friendly and nice, helpful staff - great technology so you can get a Deed or Plat map very fast, with high quality reproduction. A county deeds office can be a source of great misery if it's an inefficient and unfriendly bureaucracy (are you listening, St Louis City and County?)- I wish the Franklin County Deeds & Recorders office could give training courses to other counties!

One aspect of life that you and i will encounter when buying, selling, or looking for property owners, is using the recorder of deeds.  Yes, the ability to record has always been a precious commodity, a unique service when correctly completed.  The accurate filing is undeniably the "evidence", of who "owns", or has properly transferred the “deed of trust” per law. Yes, the securing instrument, or “deed of trust”. For those that are not familiar with this term, : “In real estate in the United States, a deed of trust or trust deed is a deed wherein legal title in real property is transferred to a trustee, which holds it as security for a loan between a borrower and lender. The equitable title remains with the borrower.”   But what of this county?  How does it "add up", when records really have to mean something,...when you or i could be facing false filing, or illegally filing where your property may be wrongfully taken. REALLY.  1st you and i need to make sure what happens at this office, is just as strict if not better, than transferring or reporting on a motor vehicle to Jefferson City. For example: you or i cannot just sell a car with a lien. Yes, you and i can, but the proper filing will show, if there is a lien, and who will need to be paid, to release the lien.   So how does that work in franklin county, you and i should examine this topic, especially since you and i may unfortunately have the need to use this service in the event your family's lively hood or home may depend on it, or in the event your property is falsely taken. So lets begin....
The unfortunate event that most are familiar with, is the subprime lending/bank bailout/money laundering, that took place for you and I. Lets just make sure we all have the same understanding 1st. During this time , many mortgages were “rolled up” into securities and sold on the stock market, problem with that. Until the “new” laws that allow electronic filing were instilled, all filing had to be completed per state statue, including ANY transfer of said deed of trust. This was not only a protection for the people, but the lender (banks) as well. As most of us have encountered with a mortgage, the mortgage company usually sells the note, almost in some cases, immediately. But does the size of the lender, or who the lender is, allow the “LENDERS” to not file their paperwork, and how is that important...,for you and I. You and I need to know this, especially if you and I are paying a filing fee for every piece of paper you and I file with this office. So if the lender sells the note, and the paperwork isn't filed from the lender, and the new “servicer” decides to service the loan incorrectly, charging fees, or fees not agreed on in the initial mortgage, what do you or I do?, where would you and i go to defend ourselves, especially if you or I only make 20k a year, and the LENDER give this county a 4million dollar tax check. Shouldn't you or I be able to go to our local recorder of deeds, get what we need and go defend ourselves, in the county the property resides?
Thanks to the electronic filing, the LENDERS and “those working with them”, could “cleanup” the paperwork that was never properly filed. Now many could say: “its just the way it is”, or “what does it matter”?, or my favorite: “the county has a fraudulent property thing you can sign up with for that”, Well lets take a look at a live example of what you and I have to contend with. This happened, and at this office, in this county, when sharon birkman was recorder.
